Privacy Policy

This Policy explains what information Gay or Nay collects, why we use it, and the choices available to you.

1. Scope

Social Positivity LLC, a Wyoming limited liability company (“Social Positivity,” “we,” “us,” or “our”), operates Gay or Nay. This Policy applies to the Gay or Nay website, game, accounts, uploads, moderation tools, and related communications. By using the service, you acknowledge the practices described here. Our Terms of Service also apply.

2. Information we collect

  • Account information: email address, authentication records, username, avatar, optional location, account status, and profile settings.
  • Photos and upload records: images you submit, original filename, upload time, consent attestations about permission and adult age, moderation history, and optional self-declared orientation. Orientation information is sensitive and is not required for community-only photos.
  • Game activity: votes, skips, views, rating contributions, fixed fictional starter-photo game answers, streaks, leaderboard results, badges, share-card requests, reports, and interactions with ads or notifications.
  • Device and network data: IP address or a cryptographic hash derived from it, browser and device type, user agent, timestamps, approximate country or region, referral source, cookies, session identifiers, security signals, and diagnostic logs.
  • Support and safety data: messages you send us, report details, administrative actions, and limited identity-verification material when needed to resolve an ownership dispute.

3. How we use information

We use information to:

  • provide accounts, uploads, voting, ratings, and leaderboards;
  • calculate and display aggregate photo results and create share cards you request;
  • review reports, enforce consent rules, moderate content, prevent duplicates, and keep immutable safety and administrative records;
  • detect bots, spam, malware, fraud, and abuse; enforce rate limits; and investigate security incidents;
  • measure usage, reliability, retention, traffic sources, and product performance and improve the service;
  • send authentication links, requested browser notifications, important account or moderation updates, and product messages where permitted; and
  • comply with law and protect users, the public, and our rights.

4. Public and aggregate information

Approved photos, usernames, avatars, aggregate vote percentages, total vote counts, public ratings, ranks, and badges may be visible to other users. Individual votes are not displayed publicly. A self-declared orientation may be used privately to calculate eligible game results, but we do not present it as independently verified fact. Fixed answers assigned to fictional starter photos may also produce rated predictions. Those answers are game mechanics, not orientation information or claims about real people. Skips and community photos without a self-declared rating answer do not affect Gaydar Ratings.

5. How we disclose information

We may disclose information to vendors that help us provide hosting, databases, image storage and processing, authentication, email, analytics, security, content scanning, and customer support. They may use information only to perform services for us under appropriate contractual restrictions.

We may also disclose information when required by law; to investigate abuse or protect rights and safety; in connection with a merger, financing, acquisition, or sale of assets; or when you direct us to share it, such as through your device's share sheet.

We do not sell personal information. We also do not share personal information for cross-context behavioral advertising. Advertisement placements in the MVP are placeholders.

6. Analytics, cookies, and local storage

We and our service providers use cookies and similar browser storage to keep you signed in, preserve game state, prevent repeat voting, protect forms, remember preferences, and understand service usage. Product analytics may include page views, feature interactions, device information, approximate geography, and traffic source. We do not intentionally send photo contents, orientation labels, report narratives, or direct contact details to product analytics.

You can restrict cookies through your browser, but essential authentication and security features may stop working.

7. Retention

We retain information only for as long as reasonably needed for the purposes described here. Account and game records generally remain while your account is active. Removed photos may remain temporarily in restricted backups, moderation records, or caches. Security, consent, report, and audit records may be kept longer to prevent abuse, resolve disputes, meet legal obligations, and preserve the integrity of administrative actions.

A dispute-verification selfie is stored temporarily, restricted to authorized reviewers, and deleted after review unless law requires longer retention.

8. Security

We use technical and organizational measures designed to protect information, including encrypted transport, access controls, row-level database policies, private storage, malware scanning, rate limits, hashed network identifiers, and administrative audit logs. No service can guarantee absolute security. Please report a suspected compromise to us promptly.

9. Your choices and privacy rights

You can update available profile information and remove your own photos from discovery through account controls. You may report a photo from the game if it shows you, lacks permission, depicts a minor, or otherwise violates our rules.

Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of personal information, or to object to or restrict certain processing. To make a request, email gayornay@gmail.com from the address associated with your account. We may need to verify your identity and may retain information where legally permitted, including safety, fraud-prevention, consent, and audit records. We will not discriminate against you for exercising a privacy right.

10. Adults only and international use

Gay or Nay is limited to people 18 and older, and we do not knowingly collect information from minors. If you believe a minor has used the service or appears in an upload, report the photo immediately or contact us.

The service is operated from the United States. If you use it from another country, your information may be transferred to and processed in the United States and other places where our providers operate, subject to applicable safeguards.

11. Changes to this Policy

We may update this Policy as the service evolves. We will post the revised version with a new effective date and provide additional notice when required by law.
